terms of service.
The agreement between you and the makers of AutoSpottr — the car-spotting game — covering your account, your subscription, and what you post to the feed.
Acceptance of these terms
These Terms of Service (the "Terms") are a binding agreement between you and Hitamo ("we," "us," "our"), the provider of the AutoSpottr mobile application and related services (together, the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
Certain features — creating an account, subscribing, and posting to the shared feed — require your explicit acceptance of these Terms and of our zero-tolerance policy for objectionable content (see Section 06). You must accept both to use those features.
Eligibility & your account
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App, and old enough to form a binding contract. Features that publish content to other users may carry a higher age rating; use them only if you meet that rating.
Accounts
You can begin as an anonymous guest. To sync across devices, appear on ladders, or post to the feed, you may create an account using Sign in with Apple or an email and password. You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly at crescent1992@gmail.com if you suspect unauthorized use.
Deleting your account
You may delete your account at any time from Profile → Delete Account inside the App. Deletion removes your profile and server-stored data, including your posts and the comments and reactions you left on other people's posts, as described in the Privacy Policy.
Licence to use the app
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded devices you own or control, for your own non-commercial enjoyment. This licence is governed by Apple's Licensed Application End User License Agreement (see Section 16), as supplemented by these Terms.
You agree not to:
- copy, modify, reverse-engineer, decompile, or create derivative works of the App, except where the law forbids that restriction;
- rent, lease, sell, sublicense, or otherwise commercialize the App or access to it;
- circumvent, disable, or interfere with security, attestation (App Check), rate-limiting, or scoring integrity;
- use bots, scrapers, or automated means to submit captures, farm XP, inflate ladder or feed rankings, or extract data;
- submit images you did not capture yourself, or that misrepresent when or where a spot was made.
Subscriptions & billing
The App is free to download and play in a limited free state. AutoSpottr Pro is an optional auto-renewable subscription that unlocks additional features. The App is not gated behind a subscription — choosing "Not now" leaves you a usable free experience.
Plans & introductory trial
| Plan | Price | Renews | Free trial |
|---|---|---|---|
| Pro — Weekly | $5.99 | Every week | 4 days |
| Pro — Monthly | $13.99 | Every month | 4 days |
| Pro — Yearly | $69.99 | Every year | 4 days |
Prices are shown in U.S. dollars; the price and currency you actually pay are those displayed at purchase for your App Store region and may vary. The 4-day free trial is an introductory offer on each plan — choosing a plan and starting the trial is a single action.
Payment, renewal & cancellation
Subscriptions are sold and processed by Apple through your Apple Account, and are governed by Apple's terms in addition to these. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends. If a free trial goes unused when you subscribe to a paid plan, the unused portion is forfeited.
You manage or cancel a subscription in Settings → your name → Subscriptions on your device — not by deleting the App. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
Refunds
Purchases are handled by Apple, so refund requests are subject to Apple's policies and are generally requested through Apple. We do not separately process payments and cannot issue App Store refunds directly. Where the law grants you a statutory right of withdrawal, that right still applies.
Changes to plans or prices
We may add, change, or discontinue plans and features, and adjust prices. For existing subscribers, price changes are handled per Apple's rules, which may require your consent before a higher price takes effect.
Your content & the feed
AutoSpottr lets you publish spots — a stylized render and details of a car you photographed — to a shared, ranked feed, and to react to and comment on other spotters' posts. Content you submit or publish is "Your Content."
Ownership & the licence you grant us
You keep ownership of Your Content. By submitting or publishing it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, publish, display, and distribute Your Content for the purpose of operating, providing, promoting, and improving the App and its feed. This licence ends when you delete the content or your account, except for copies retained in backups for a limited period or where we must keep them to comply with law.
A garage render is a stylized recreation generated from your masked photo — not the photograph itself — and is filed to a shared library keyed to the car's specification, not to you.
This means the first spotter to catch a given car pays to generate its render, and everyone who catches the same car afterward is served that same file. By spotting a car, you agree renders may be shared with other spotters this way.
Your promises about Your Content
- you captured the photo yourself and have the rights needed to submit it;
- it does not infringe anyone's intellectual property, privacy, or other rights;
- it complies with Section 06 and does not depict a restricted, secure, or prohibited site, an identifiable license plate or face left unmasked, or a person who has not consented.
We do not endorse Your Content and are not responsible for it. We may, but are not obliged to, review, refuse, rank, limit the reach of, or remove any content at our discretion.
Acceptable use & zero tolerance
We operate a zero-tolerance policy for objectionable content and abusive behavior. By using feed features you accept this policy. You must not submit, post, or transmit content, or behave in ways, that:
- are unlawful, harassing, threatening, hateful, defamatory, or that target a person or group;
- are sexual, obscene, violent, or otherwise inappropriate for a general audience;
- depict, identify, or endanger private individuals without consent — including unmasked faces or plates;
- reveal, or photograph, restricted, military, government, or otherwise sensitive locations;
- infringe intellectual-property or privacy rights, or impersonate another person;
- are spam, fraudulent, or intended to manipulate scoring, ranking, or moderation.
Violations may result in content removal, feature restriction, or account termination without notice. There is no tolerance for abusive users, and we may remove them from the community.
Reporting, blocking & moderation
Every post in the feed can be reported, and any spotter can be blocked. Reports are triaged automatically against per-reason thresholds: some categories — for example a post in a wrong or restricted place, or one showing a person — remove the post on a single report, because the cost of leaving such content up outweighs the cost of a false report. Other categories aggregate reports before action.
Before a spot ever reaches the feed, an automated safety pass screens it and holds flagged captures out of the stream. We aim to act on reported content promptly and review unresolved reports on an ongoing basis. Blocking a spotter hides their content from you and yours from them.
These measures are provided to keep the community safe but are not guarantees; automated systems make mistakes in both directions. If you believe we acted wrongly, contact us at crescent1992@gmail.com.
Privacy & on-device masking
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms. In summary, and without limiting that policy:
- License plates and faces are masked on your device before any image leaves your phone, using an opaque redaction rather than a reversible blur.
- Image metadata (EXIF/GPS) is stripped by re-rendering the image before upload.
- No representation of a license plate is stored or transmitted — not the characters, a partial, or a hash.
- Precise location is never stored. A single coarse fix is checked on-device against restricted-site zones and discarded; only a country code is kept, per capture, for achievements, and only if you allow location access.
- The masking pipeline fails closed: if it cannot verify an image is clean, that capture stays on your device and is not uploaded.
Please read the full Privacy Policy for details on what we collect, how it is used, retention, and your rights.
Our intellectual property
The App — including its software, design system, rarity and scoring engine, artwork, fonts, wordmark, and the "AutoSpottr" name — is owned by us or our licensors and protected by intellectual-property laws. Except for the licence in Section 03, these Terms grant you no rights in our intellectual property. Vehicle makes, models, and marques referenced in the App belong to their respective owners; their appearance does not imply any affiliation or endorsement.
Third-party services
The App relies on third-party services to function, including Apple (distribution and payments), Google Firebase (accounts, storage, and backend), and an AI image-recognition service used to identify captured vehicles. Masked images and limited data are processed by these providers under their own terms and privacy policies. We are not responsible for third-party services, and your use of them may be subject to separate agreements.
Suspension & termination
You may stop using the App at any time and delete your account from within it. We may suspend or terminate your access, or remove content, at any time — with or without notice — if you breach these Terms, create risk or legal exposure, or engage in prohibited conduct. On termination, the licence in Section 03 ends and you must stop using the App. Sections that by their nature should survive termination — including content licences already granted, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.
Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free, that recognition, scoring, rankings, or moderation will be accurate, or that content will be free of objectionable material.
Spot responsibly. Never trespass, break traffic or safety laws, photograph people without consent, or enter restricted areas to make a capture. You are solely responsible for how and where you use the App. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we and our licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the App or these Terms, even if we were advised of the possibility. Our total liability for all claims relating to the App is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD $100. Some jurisdictions do not allow these limits, so they may not fully apply to you; nothing here limits liability that cannot be limited by law.
Indemnification
You agree to indemnify and hold harmless Hitamo and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the App, or your breach of these Terms or of any law or third-party right.
Changes to the terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Changes take effect when posted. Your continued use of the App after changes take effect means you accept the revised Terms; if you do not agree, stop using the App and, if you wish, delete your account.
Apple & App Store terms
The following apply because the App is distributed through Apple's App Store:
- These Terms are between you and Hitamo only, not with Apple. Apple is not responsible for the App or its content.
- Your licence to use the App is limited to Apple-branded devices you own or control, and is subject to the Usage Rules in Apple's Media Services Terms and Conditions, including Apple's standard Licensed Application End User License Agreement (EULA). Where these Terms conflict with that EULA, that EULA governs to the extent of the conflict.
- Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App, including product-liability, legal or regulatory, or consumer-protection claims.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Apple is not responsible for investigating or resolving any third-party intellectual-property claim relating to the App.
- You represent that you are not in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce them against you as a third-party beneficiary.
